P. v. Juarez
A jury found defendant Ernie Juarez guilty of possession of heroin for sale and possession of cocaine base for sale. In bifurcated proceedings, the court found two prior drug convictions and one prior prison term allegation to be true.
The court sentenced defendant to state prison for an aggregate term of 11 years. The court stayed the prior prison term enhancement.
Defendant appeals. He contends: (1) the trial court committed prejudicial error in admitting evidence of defendants prior drug dealing under Evidence Code sections 1101, subdivision (b) and 352; (2) the trial court failed to instruct sua sponte on accomplice testimony; and (3) the prosecutor committed prejudicial misconduct in closing argument. Court reject defendants contentions and affirm the judgment.
