P. v. Munizza
David Munizza, a person twice convicted of a felony in this state, petitioned the Superior Court of San Diego County for a certificate of rehabilitation and pardon pursuant to Penal Code sections 4852.01 and 4852.06. The district attorney opposed the petition, arguing Munizza was ineligible because he is not a resident of California and because he had not resided in this state for the period after discharge from parole required by the sections. The trial court found the residency requirements unconstitutional as violative of Munizza's right to equal protection of the law and his right to travel. The trial court granted the certificate of rehabilitation. The district attorney appeals. The order granting a certification of rehabilitation is reversed.
