P. v. Garcia
Defendant David Garcia appeals from a judgment entered after a jury found him guilty of attempted, willful, deliberate, premeditated murder (Pen. Code, 664/187, subd. (a))[1]and assault with a deadly weapon. ( 245, subd. (a)(1).) The jury found true the allegations that defendant personally used a deadly and dangerous weapon within the meaning of section 12022, subdivision (b)(1); that defendant personally inflicted great bodily injury within the meaning of section 12022.7, subdivision (a); and that defendant committed those offenses for the benefit of, at the direction of, and in association with a criminal street gang with the specific intent to promote criminal conduct within the meaning of section 186.22, subdivision (b)(1). The trial court found true the allegation that defendant had suffered a prior conviction of a serious or violent felony pursuant to sections 667, subdivisions (b) through (i), and 1170.12, subdivisions (a) through (d).
The judgment is affirmed.
