Eriksson v. Cal. State Univ. Fresno
Eighteen year old Shana Eriksson (Shana) was tragically killed while riding a horse on the California State University, Fresno (CSUF) campus. Shana was a CSUF student and a member of the CSUF intercollegiate equestrian team.
In this appeal Shanas parents, appellants Stan Eriksson and Karan Eriksson, challenge the trial courts conclusion that their action against CSUF is barred by the primary assumption of risk doctrine. According to appellants, CSUF neither adequately supervised Shana nor warned her of the dangers of riding near livestock on the CSUF campus, and thus increased the risk of harm inherent in the sport of horseback riding.
