It is
ordered that the opinion filed herein March
15, 2012, is modified as
follows:
1. On page 21, second paragraph, line one, a
period is inserted following the word “harmless” and the words “beyond a
reasonable doubt” are deleted.
2. The following citation is added: (People
v. Watson (1956) 46 Cal.2d 818, 836.)
The former
first sentence at line one of paragraph two on page 21 now reads:
On the evidence in this
case we are unable to find that this error was
harmless. (People
v. Watson (1956) 46 Cal.2d 818, 836.)
There is no
change in the judgment.
Respondent’s
Petition for Rehearing is denied.
