v.

LOUIS E. GOEBEL,

Defendant and Appellant.

(Super. Ct. No. 37-2007-00068187-

ORDER MODIFYING OPINION

[NO CHANGE IN JUDGMENT]

THE COURT:

Through inadvertent error, the signature block in the disposition of the opinion filed September 18, 2008, included a justice who was not a member of the panel. This order corrects that error by deleting the signature of Justice Patricia D. Benke and including the signature of Justice Terry B. O'Rourke, who participated on the panel. There are no other changes to the opinion.

DISPOSITION

Order reversed. The trial court shall vacate its order denying Goebel's anti-SLAPP motion and issue an order granting the motion and dismissing the Robinsons' complaint. Respondents to pay appellant's costs on appeal.

HALLER, Acting P. J.

WE CONCUR:
