IT IS ORDERED that the opinion filed in the above-captioned matter on
January 28, 2008, and not certified for publication, be modified as follows:
On page 2, delete the words one-half from the third line of the first paragraph.
On page 3, from the third paragraph, third sentence which begins with the words

On page 3, after the third sentence of the third full paragraph, add the following sentence: The partnership has approximately 40 fractional owners. The Ellis Ring Trust affiliates own approximately 39.0042 percent, the Douglas Ring Affiliates own
approximately 37.8206 percent, and the rest is held by other individuals and trusts in shares ranging from 4.4380 percent to 0.1972 percent.
The petition for rehearing is denied. The foregoing does not effect a change in the judgment.
