COURT OF APPEAL, FOURTH APPELLATE DISTRICT

DIVISION ONE

STATE OF CALIFORNIA

THE PEOPLE, D086860

Plaintiff and Respondent, (Super. Ct. No. CR75335

v.

LEE QUILLAR,

Defendant and Appellant.

APPEAL from an order of the Superior Court of San Diego County,
Theodore M. Weathers, Judge. Affirmed.
Jennifer A. Gambale, under appointment by the Court of Appeal, for
Defendant and Appellant.
No appearance for Plaintiff and Respondent.

In 1985, Lee Quillar, then 17 years old, was charged in the Superior
Court with multiple felonies. He pleaded guilty to grand theft from the
person (former Pen. Code, § 487.2) and assault with a deadly weapon (§ 245,
subd. (a)(1)). Quillar was sentenced to prison for four years eight months.
In January 2018, Quillar petitioned for resentencing under Penal Code
section 1170.18 with regard to the grand theft conviction. The petition was
granted as to that count.
Quillar is currently serving a determinate term of 11 years and a
consecutive indeterminate term of 25 years to life from a separate offense
with a prior strike in case No. SCE171374.
In 2024, Quillar filed a request to transfer his case to juvenile court
under Welfare and Institutions Code section 707.5. The trial court denied the
request.
Quillar filed a timely notice of appeal.
Appellate counsel has filed a brief under the procedure established by
People v. Delgadillo (2022) 14 Cal.5th 216 indicating counsel has not been
able to identify any arguable issues for reversal on appeal. Counsel is aware
this court is not required to independently review the record for error in an
appeal governed by Delgadillo. Counsel argues we should exercise our
discretion and independently review the record for error. We will
independently review the record in this case.
We have advised Quillar he could file his own brief on appeal, but he
has not filed any briefing.
DISCUSSION
As we have noted appellate counsel has filed a brief which does not
raise any arguable issues for reversal on appeal. To assist the court in its
review of the record and in compliance with Anders v. California (1967) 386
U.S. 738, counsel has identified a possible issue which was considered in

evaluating the potential merits of this appeal. Whether the trial court erred
in denying Quillar’s petition for retroactive transfer to the juvenile court.
We have exercised our discretion to review the record for error. Our
review has not discovered any arguable issues for reversal on appeal.
Competent counsel has represented Quillar in this appeal.
DISPOSITION
The order denying appellant’s request for transfer to the juvenile court
is affirmed.
