It is ordered that the opinion filed herein on January 23, 2009, be modified as follows:
On page 2, the first full paragraph, first sentence following the heading STATEMENT OF FACTS delete the date September 30, 2009, and insert the date September 30, 2008, so that the sentence reads:
In the petition for writ of habeas corpus filed on September 30, 2008, petitioner raises issues regarding his failure to timely file a notice of appeal from his 2007 felony convictions in Stanislaus County Superior Court.
Except for the modification set forth, the opinion previously filed remains unchanged.
This modification does not effect a change in judgment.
