THE COURT:

It is ordered that the opinion filed herein on July 23, 2008, be modified as follows:

On page 2, first sentence of the fourth full paragraph, the sentence beginning "Approximately a week prior" is deleted and the following sentence is inserted in its place:

Approximately a week prior to his death, Serfie informed Linda that he "changed the will" in September 2004, and "gave the ranch to Cindy and Joe Muscio."

There is no change in the judgment.

Appellants' petition for rehearing is denied.
